Terms and Conditions
1. Introduction
Welcome to Gilbert & Holle Moving Co.. By using our services, you agree to the following terms and conditions. Please read them carefully.
1.1 Definitions
· “Company”: Refers to Gilbert & Holle Moving Co.
· “Customer”: Refers to any individual or entity using the services of the Company.
· “Services”: Refers to the removal, transportation, and storage services provided by the Company.
2. Services Provided
2.1 Removal Services
The Company will provide removal services as agreed in the contract. This includes packing, transportation, unloading, and unpacking of goods.
2.1.1 Furniture placement
Once the furniture has been moved into the designated location, it will not be relocated or rearranged by the Company. The Customer is responsible for ensuring the final placement of furniture during the move.
2.2 Storage Services
If required, the Company will provide storage services for the Customer’s goods at an additional cost as outlined in the agreement.
2.3 Special Items
Items such as pianos, antiques, and other valuables require special handling and may incur additional charges. The Customer must inform the Company of such items in advance.
2.4 delays
Should the removal not be able to take place for any reason out of the control of the company we reserve the right to put the items into storage or return to the departed address until such time the goods are able to be delivered to the arrival address and costs incurred will be forwarded and payable by the owner of the goods.
3. Customer Responsibilities
3.1 Accurate Information
The Customer must provide accurate information regarding the inventory, access to the property, and any special requirements.
3.2 Packing
If the Customer opts to pack their own belongings, they must ensure that all items are securely packed to prevent damage during transit.
3.3 Waiver requirements
In instances where the Customer chooses to undertake the packing of their possessions, it is essential that each item is meticulously packed, ensuring precision and attention to detail. This vigilant method greatly reduces the potential for damage during transportation. If the Company determines that the packing does not conform to the requisite safety and security protocols, the Customer may be asked to sign a waiver. This waiver serves to absolve the Company from any liability for damages sustained during the moving process.
Furthermore, in instances where the Customer intends to transport items that fall outside the Company's regular scope of handling due to considerations of safety, legality, or ethical standards (as delineated in section 3.4), the Customer may also be required to sign a waiver. This acknowledgment confirms that the Company bears no responsibility for any complications that may arise from the transportation of such goods.
3.4 Items we DO NOT handle
The Company does not handle certain items due to safety, legal, or ethical reasons. These items include, but are not limited to:
Hazardous materials (e.g., chemicals, explosives, paint)
Refrigerated, open (liquid form) or frozen food or drink
Illegal items (e.g., drugs, stolen property)
Valuable items (e.g., cash, jewellery, important documents, stamp, collection and other items of this nature)
Any other such item the removal team deem as unsafe to move/transport.
The customer must remove all items listed above from the property, separate from the goods being packed or transported.
As outlined in our terms and conditions, the company is not liable for any lost or stolen valuable items. It is recommended to avoid bringing jewellery to the premises as these items can be easily misplaced.
3.5 Withdrawal and Payment Obligation
If the Customer opts to pack their own belongings and is not ready for the removal team on the scheduled move day, the Company reserves the right to withdraw from the job without issuing a refund. In such cases, any outstanding payment will still be owed to the Company.
3.6 Responsibility of placements
Ensure you are or an appointed person is present at the departure address and arrival address to ensure that nothing is removed or left in error or in the incorrect rooms.
3.7 Ownership
By entering into this contract you confirm you are the owner or has consent from the owner to to make this contract in respect of the goods.
4. Payment Terms
4.1 Payment Schedule
Payment must be made in accordance with the agreed-upon schedule. Payment must be made 1 day before the service. A deposit may be required to secure the booking.
4.2 Additional Charges
Any additional charges incurred during the move, such as unforeseen labour or materials, must be paid in full upon completion of the services.
5. Liability and Insurance
5.1 Limitation of Liability
The Company’s liability for any loss or damage is valued at the original cost of the goods minus depreciation on when a declaration of value has been submitted. Should we not receive a declaration a payment up to the amount of £50.00 sterling will be paid for each item. In this respect an item is defined as any one article, suite, pair, set, complete case, package, carton or other container.
5.2 Insurance
The Company provides basic insurance coverage for the goods. Please note that there is an insurance excess of £250. The Customer may opt for additional coverage at an extra cost. Insurance claims must be made within 7 days of the service being completed.
6. Cancellations and Rescheduling
6.1 Cancellation Policy
Cancellations must be made at least 48 hours prior to the scheduled move. Failure to do so may result in a cancellation fee of 50% of the cost.
6.2 Rescheduling
The Customer may reschedule the move subject to availability and must inform the Company at least 48 hours in advance.
6.2 Service refunds
If the Company fails to provide the agreed-upon services due to negligence or other reasons within the Company's control, a partial or full refund may be issued based on the extent of the failure.
7. Dispute Resolution
In case of any disputes arising from the services, both parties agree to resolve the matter through negotiation and mediation before seeking legal action.
8. Governing Law
These terms and conditions are governed by the laws of the jurisdiction in which the Company operates.
9. Amendments
The Company reserves the right to amend these terms and conditions at any time. Customers will be notified of any changes.
